Terms for digital products and software.
These Terms apply to eligible digital products and software supplied under the D’AUBE SONNTAG brand. D’AUBE SONNTAG is operated as a sole-trader business based in Vietnam.
1. Scope
These Terms govern access to and use of D’AUBE SONNTAG digital products, downloadable creative assets, templates, UI kits, software tools and related digital materials (collectively, the “Products”). Product-specific descriptions, license terms, technical requirements and pricing shown before checkout form part of these Terms.
2. Orders and Paddle
For Products sold through Paddle, Paddle acts as our online reseller and Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, tax collection, billing, invoicing and payment-method handling for Paddle orders are performed through Paddle’s checkout. D’AUBE SONNTAG does not receive or store complete payment-card numbers, CVV/CVC, PINs or banking authentication secrets.
3. Pricing and billing
Prices, currencies and whether a Product is a one-time purchase or subscription are displayed before checkout. Unless a Product page clearly states recurring billing, the Product is sold as a one-time purchase. Applicable sales taxes or VAT may be added or included according to the buyer’s location and Paddle’s checkout rules.
4. Digital delivery
After successful payment, Products are delivered digitally by download, access link, account entitlement, license key or another method stated on the relevant Product page. Buyers are responsible for providing a valid email address and maintaining reasonable access to the device, browser or software environment required for delivery.
5. Licenses and intellectual property
Unless a Product page states otherwise, purchase grants the buyer a limited, non-exclusive, non-transferable license to use the Product for the permitted purposes described with that Product. Ownership of the Product, source materials, trademarks, design systems and other intellectual property remains with D’AUBE SONNTAG or the identified rights holder.
Buyers must not resell, redistribute, sublicense, publish source files as a competing asset, remove rights notices, or use a Product in a way that exceeds the stated license. Open-source components, third-party fonts, libraries or other bundled materials may be governed by their own licenses, which take precedence for those components.
6. Acceptable use
Products must not be used for unlawful activity, fraud, abuse, infringement, malware distribution, unauthorized surveillance, deceptive impersonation, or other prohibited conduct. We may suspend access where reasonably necessary to protect users, the Product, our infrastructure, Paddle, or applicable legal obligations.
7. Refunds and mandatory rights
Refunds are governed by our Refund Policy together with Paddle’s applicable buyer terms and refund process for Paddle-processed orders. Nothing in these Terms removes consumer rights that cannot lawfully be waived in the buyer’s jurisdiction.
8. Support and updates
The support period, update policy and compatibility commitments for a Product are those stated on its Product page. Unless expressly promised, purchase does not guarantee indefinite updates, custom development, bespoke support or compatibility with future third-party software or operating-system changes.
9. Availability and warranties
We aim to describe Products accurately and deliver them as stated. Except for obligations that cannot be excluded by law, Products are provided subject to the specifications and limitations disclosed on the Product page. We do not promise that every Product will meet every buyer’s particular purpose, work with unsupported environments, or remain compatible with third-party services outside our control.
10. Liability
To the maximum extent permitted by applicable law, D’AUBE SONNTAG is not responsible for indirect, incidental or consequential loss arising solely from unsupported use, unauthorized modification, misuse, or third-party systems outside our reasonable control. Nothing in these Terms excludes liability where exclusion would be unlawful.
11. Changes
We may update these Terms to reflect changes in Products, law, security, operations or payment-provider requirements. Material changes will be published on this page with a new effective date. Terms applicable at the time of purchase continue to govern that order unless mandatory law requires otherwise.
